Told Together Terms of Use

Welcome to Told Together. These Terms of Use ("Terms") are a legal agreement between you and Told Together, LLC ("Told Together," "we," "us," or "our") governing your use of our website, web app, and related services (the "Service").

Please read these Terms carefully. By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use the Service

The Service is offered to residents of the United States and is not directed at residents of other countries. To use the Service you must:

  • Be at least 18 years old.
  • Be able to form a legally binding contract under applicable law.

If you don't meet these criteria, do not create an account.

2. Your account

You are responsible for:

  • Providing accurate registration information.
  • Keeping your password confidential.
  • Everything that happens under your account.

We will ask you to verify your email address before you can record or upload for the first time. Notify us promptly at support@toldtogether.com if you believe your account has been compromised.

3. What the Service does

Told Together helps families preserve memories by turning recorded conversations — usually an interview between two people — into written stories. You can record an interview live through the Service (together on one device, or over a video call), upload a recording you made elsewhere, or type a story out. The Service transcribes recordings using third-party AI services and generates a written story using AI. You can edit, share, and export your content.

AI-generated transcripts and stories can contain errors, omissions, and inaccurate statements. You should review and edit AI output before relying on it or sharing it. Told Together is not responsible for the accuracy of AI-generated content.

4. Recording consent

You are responsible for obtaining consent from every person you record using the Service, and for getting permission from everyone in any recording you upload before you share it with Told Together. This applies whether the recording was made with the Service or somewhere else, such as a phone's voice memo app. Some US states (including California, Florida, Illinois, Massachusetts, Pennsylvania, and Washington) require all participants in a recorded conversation to consent to being recorded.

By using the Service, you represent and warrant that:

  • Every participant in every interview you record has consented to being recorded, transcribed, and having a written story generated from the recording.
  • Everyone who can be heard or seen in any recording you upload knew they were being recorded and gave you permission to share it with Told Together, so that it can be transcribed and turned into a written story.
  • You have the right to upload any photos or other materials you add.
  • You have the right to share any content with the recipients you choose.

If an interview involves a minor, you represent that you have obtained consent from the minor's parent or legal guardian.

Guest participants. A person you interview over a call does not need an account. Before joining, they are shown who invited them and told that the call will be recorded. Guests are not bound by these Terms, but they may ask us to remove a recording they appear in — see the Privacy Policy section "If you were recorded by a Told Together user."

5. Your content

You keep ownership of your recordings, transcripts, stories, photos, and any other content you create or upload through the Service (your "Content"). You do not lose any rights to your Content by using Told Together.

To operate the Service, we need a limited license from you. You grant Told Together a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, transcribe, adapt (for the purpose of writing the story), and display your Content solely to provide the Service to you and, as described in our Privacy Policy, to improve it. This license ends when you delete your Content or close your account, except for short-lived copies retained in backups as described in our Privacy Policy.

We will not:

  • Use your Content to train AI models.
  • Use your Content in marketing or promotions without your express permission.
  • Sell your Content.

If you send us suggestions or feedback about the Service, we may use them without any obligation to you.

6. Acceptable use

Don't use the Service to:

  • Record or share content involving people who haven't consented.
  • Upload illegal, harassing, defamatory, or infringing content.
  • Impersonate another person.
  • Violate any law.
  • Interfere with the Service, attempt to break security, or scrape the Service.
  • Reverse-engineer or copy the Service.

We may suspend or terminate your account for any violation.

7. Subscriptions and billing

The Service is currently free. We plan to offer paid subscriptions in the future. When we do:

  • Subscription fees, billing cycles, and renewal terms will be disclosed at the time of purchase.
  • Subscriptions auto-renew unless you cancel before the renewal date.
  • You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period.
  • Fees are generally non-refundable except as required by law. If you believe you've been charged in error, email support@toldtogether.com within 30 days.
  • California residents: Consistent with California's Automatic Renewal Law, we will clearly disclose auto-renewal terms at signup, send renewal reminders for annual plans, and allow you to cancel online without calling us.

Payments are processed by our payment processor (currently Stripe, Inc.). You agree to the payment processor's applicable terms.

8. Third-party services

The Service relies on third-party services (AI providers, hosting, email, payments, analytics). Those services have their own terms and privacy policies, and we are not responsible for them. See our Privacy Policy and Subprocessor List.

9. Our intellectual property

The Told Together name, logo, website, software, and design are our property (or our licensors'). You don't get any rights to them other than the right to use the Service under these Terms. Don't copy, modify, or redistribute our materials.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE OR COMPLETE.

Told Together is not a substitute for professional advice (legal, medical, financial, or otherwise).

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOLD TOGETHER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) USD $100.

Some jurisdictions don't allow these limits; in those jurisdictions, they apply only to the extent permitted.

12. Indemnification

You agree to defend and indemnify Told Together against claims arising from (a) your Content, (b) your violation of these Terms, (c) your violation of any law, and (d) recordings made without required consent.

13. Termination

You can close your account at any time in your account settings. We may suspend or terminate your account for violations of these Terms or for legal or security reasons. When your account is closed, we will delete your Content as described in our Privacy Policy.

We may change, add, or remove features of the Service. If we discontinue the Service, or a feature you need to reach your Content, we will give you reasonable notice and a way to retrieve your Content first.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.

15. Dispute resolution

We hope we never have a dispute. If one comes up, please email us first so we can try to resolve it directly.

Informal resolution first. Before starting arbitration or a lawsuit, you agree to send a written notice of the dispute to the address in section 18 describing the problem and what you want. We will do the same for disputes we raise. If we haven't resolved it within 60 days of the notice, either side may proceed.

Arbitration. Any dispute arising out of or relating to the Service or these Terms that is not resolved informally will be settled by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and its Consumer Arbitration Minimum Standards. Hearings will be held by video or in the county where you live. Fees are allocated under the JAMS consumer rules, which limit your share to a filing fee. Either party may instead bring an individual claim in small-claims court.

Your right to opt out. You may reject this arbitration section by emailing support@toldtogether.com within 30 days of first accepting these Terms, with your name and account email. Opting out doesn't affect the rest of these Terms.

No class actions or jury trials. YOU AND TOLD TOGETHER AGREE THAT CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY, NOT AS PART OF A CLASS OR REPRESENTATIVE ACTION, AND WAIVE ANY RIGHT TO A JURY TRIAL. If the class-action waiver is found unenforceable for a particular claim, that claim will proceed in court, not arbitration, and the rest of this section still applies to all other claims.

Coordinated filings. If 25 or more similar claims are filed against us by the same or coordinated counsel, they will be resolved in staged batches under JAMS's mass-arbitration procedures, with a test group first.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email and ask you to accept the updated Terms the next time you use the Service. If you don't agree to the updated Terms, you can close your account; your Content remains available to export until you do.

17. Miscellaneous

  • If any provision of these Terms is unenforceable, the rest will remain in effect.
  • Our failure to enforce a provision is not a waiver.
  • You can't assign these Terms without our consent; we can assign them to a successor in connection with a merger or acquisition.
  • These Terms are the entire agreement between you and Told Together regarding the Service.
  • We may send notices to the email address on your account; you may send notices to the address below.
  • Sections 5 (Your content), 10 (Disclaimers), 11 (Limitation of liability), 12 (Indemnification), 14 (Governing law), and 15 (Dispute resolution) survive the end of these Terms.
  • These Terms do not create any rights for third parties.
  • Neither party is liable for delays or failures caused by events outside its reasonable control, except for payment obligations.
